How does the Apple and FBI battle over privacy affect Digital Business

The recent arguments between Apple and the FBI bring the idea of a right to personal privacy into everybody’s mind again. And both sides make very good points in their case.

While not explicitly part of the U.S. Constitution the right to be left alone or the right to personal autonomy is addressed in the 1st, 2nd, 4th, 5th, 9th, and 14th amendments.

While numerous case rulings and precedence have sought to narrow the definition of privacy. I expect that if this goes to trial the court will not surprise in their ruling on this case either and will do what they always do - they will narrowly define privacy. The U.S. Supreme Court views the right to personal privacy on a case-by-case basis. Public opinion changes with the times, as do the boundaries of personal privacy.

In IT digital transformations the very idea of privacy could seem like an impediment to business. But, the best businesses’ today are the leading advocates for personal privacy because they know that a happy customer stays a customer. Businesses are happy if they can simultaneously balance the protection of consumer’s right to privacy while building a service that enables user to give, manage and revoke their specific consent decree for value added service providers having access to their personal information.

Businesses should see that privacy and consent go together as a tool to manage competition between 3rd party service providers while letting consumers make their own personal choice.
